1. Acceptance of Terms
By accessing or using DivePulse (pulseofdiving.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
Creating an account constitutes acceptance of these terms. A record of your acceptance (including timestamp) is stored with your account.
2. Nature of Data — Guidance Only
DivePulse aggregates publicly available weather and marine data from third-party sources (including Open-Meteo and Stormglass) and presents it as a convenience tool for divers.
All data on this platform is guidance only. It is not:
- A guarantee of actual conditions at any dive site
- A substitute for your own on-site assessment
- Certified or verified marine safety information
- A recommendation to dive at any particular time or location
Conditions change rapidly. Forecasts may be inaccurate. Sensor data may be delayed or incorrect. Always verify conditions independently before diving.
3. Limitation of Liability
To the maximum extent permitted by applicable law, PulseOfDiving and its operators shall not be liable for any loss, injury, death, or damage (direct, indirect, consequential, or otherwise) arising from:
- Reliance on any data, score, rating, or forecast shown on this platform
- Decisions to dive or not dive based on information provided
- Inaccurate, delayed, or missing condition data
- System downtime, errors, or unavailability
Diving is an inherently dangerous activity. You accept full responsibility for your own safety and the safety of those in your care.
4. User Responsibilities
By using DivePulse, you agree to:
- Independently verify all dive conditions before entering the water
- Hold appropriate certifications for any dives you undertake
- Comply with all applicable local laws, bylaws, and maritime regulations
- Not share your account credentials with others
- Provide accurate information when registering
5. Third-Party Data Sources
Condition data is sourced from third parties including Open-Meteo and Stormglass. DivePulse does not guarantee the accuracy, completeness, or timeliness of data from these sources. Availability of third-party data may change without notice.
6. Premium Subscription
Premium subscriptions are billed monthly at €7/month. Subscriptions can be cancelled at any time. No refunds are provided for partial months unless required by applicable consumer law.
Premium features (extended forecasts, email alerts) are provided on a best-efforts basis. Service availability is not guaranteed.
7. Privacy
We collect your email address and name for account management and, if subscribed, to send dive condition alerts. We do not sell your data to third parties.
A full privacy policy will be provided pending solicitor review.
8. Changes to Terms
These terms may be updated from time to time. Continued use of the service after changes constitutes acceptance. Material changes will be communicated by email where possible.
9. Governing Law
These terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
